Property Management Services Authority Supports 
the Government’s Proposed Amendments to the Building Management Ordinance

Improving Building Management Arrangements 
Enhancing Building Safety and Management Quality

The Government is currently conducting a public consultation on the proposed amendments to the Building Management Ordinance (BMO) (Cap. 344). The Property Management Services Authority (PMSA) held a meeting recently to collect views from its members on the proposed amendments. Ms Priscilla TO, Director of Home Affairs, attended the meeting to listen to the views of PMSA members. The PMSA supports the proposed directions for amendment put forward by the Government and has provided specific views from the practical operation perspective of property management (PM).

During the meeting, PMSA members unanimously supported the Government’s proposal to amend the BMO in five major directions, including imposing a higher attendance requirement and voting thresholds for decisions on large-scale maintenance procurement and high-value procurement, improving the system for proxy instruments, optimising the system for declaration of interests, strengthening the powers of the Authority, and clarifying meeting procedures. PMSA members, inter alias, agreed that raising attendance and voting thresholds would help strengthen owners’ participation, improving the declaration of interest regime would enhance the transparency of procurement exercises, and clarifying meeting procedures would better safeguard owners’ rights. PMSA members also provided views from the practical operation perspective of the PM industry, in particular on matters relating to proxy instruments.

Dr James WONG, Chairperson of the PMSA, said, “As the statutory regulatory body of the PM industry, the PMSA welcomes and supports the Government’s continued efforts to improve the regulatory regime for building management. The PMSA recognises that amendments to the BMO will help the PM industry assist owners and owners’ corporations in handling building management matters in a lawful, orderly and more effective manner under a clearer legal framework, thereby further enhancing the quality of PM services and the professional standard of the industry.”
 
Dr WONG added, “The PMSA will continue to maintain close communication with the Home Affairs Department and other stakeholders, reflect the views of the industry, and assist the Government in formulating amendment proposals that are practical, feasible and meet the needs of various parties. Before the relevant amendments are implemented in the future, the PMSA will update the corresponding Codes of Conduct and Best Practice Guides to provide clear guidance for the industry, ensuring that the new requirement can be effectively implemented.”
