Privacy Policy Statement

The Property Management Services Authority (PMSA) is:

  1. dedicated to the protection of personal data privacy; and
  2. committed to the compliance with the Personal Data (Privacy) Ordinance (Cap. 486), in particular the Data Protection Principles.

Personal Data Collected

The PMSA collects and holds / will collect and hold four broad categories of records which contain personal data. Besides, prior to collecting such personal data, the PMSA will provide the data subject with its Personal Information Collection Statement in an appropriate form and manner:

  1. Licensing records – contain information collected in connection with applications for and issue of licences under the Property Management Services Ordinance (Cap. 626) and its subsidiary legislations (PMSO).
  2. Complaint, investigation and disciplinary proceedings records – contain information collected in respect of complaints made to and investigations and disciplinary actions conducted by the PMSA in the discharge of its functions under the PMSO.
  3. Personnel records – contain personal details, curriculum vitae and job particulars of applicants for positions and other relevant information of staff members in the PMSA.
  4. Other records – contain information provided to the PMSA by applicants or participants of various activities and enquiries from the public.

Purposes of Collecting Personal Data

Personal data are collected and kept for the following main purposes:

  1. Processing applications for licence – for processing applications for licence, for keeping registers of property management companies and property management practitioners, and for making the registers and list of licensees available for public inspection.
  2. Investigating complaints, suspected disciplinary offences and failure to meet licensing criteria, and taking disciplinary actions – for taking actions on complaints and suspected disciplinary offences, and for conducting disciplinary hearings.
  3. Discharging human resources functions – for staff recruitment and management, and for other human resources functions.
  4. Other purposes – for other purposes such as office administration, procurement of goods and services, organisation of promotional, training and other activities, and handling enquiries from the public.
  5. Generally, personal data are collected and kept for the purpose of exercising the powers and discharging the functions of the PMSA under the PMSO and for compliance with legal and statutory requirements.

Main Purposes for Keeping/Holding Personal Data

  1. Complaint and Investigation Records – To perform the statutory functions of the PMSA, including but not limited to responding to complaints or inquiries, conducting investigations, mediation and/or disciplinary proceedings, or any related purposes.
  2. Personnel Records – For any human resources management related to the PMSA, including recruitment, employee benefits, termination, performance appraisal, disciplinary matters, etc., and to comply with relevant legislation, including but not limited to the Inland Revenue Ordinance (Cap. 112) and the Mandatory Provident Fund Schemes Ordinance (Cap. 485).
  3. Other Records – For various purposes depending on the nature of the records, such as administrative work related to the PMSA's functions and activities, seeking advice on policy or operational matters, organizing promotional, educational and training activities, procuring materials and equipment, obtaining services, subscribing to publications, processing compliance reviews or verifying licence applicant information, and handling public inquiries, etc.

Information Collected When Users Visit Our Website

The PMSA will record the number of visits to this website without collecting any personally identifiable information of users, for the purpose of compilation of statistics and the diagnosis of problems with or concerning computer information systems to help the PMSA improve this website.

Cookie is a small piece of data stored in the user’s computer hard drive when a user visits this website. Cookies are used to enhance users’ browsing experience. The PMSA will not collect any personal data from users under this circumstance. Users have a choice not to accept the cookies. If a user does not accept cookies, certain functions on this website may not be available to the user.

Disclosure of Personal Data

The complainant/licence applicant/any person providing personal data to the PMSA must indicate consent for the PMSA to copy any information provided (including their personal data) and transfer it to persons or organisations contacted by the PMSA in handling the case, for the purpose of processing their complaint/application/request for the PMSA to handle the matter.

Personal data collected by the PMSA in the course of performing its statutory functions may be disclosed to persons or organisations authorised to receive information relating to law enforcement, prosecution, or review of decisions.

Provision of Personal Data

For different purposes and at different times, users may be invited to provide personal data to the PMSA through this website on a voluntary basis. Personal information may include name, telephone number, mailing address and e-mail address. When inviting a user to provide such information, the PMSA will specify the collection purpose and intended usage of the data and provide advice on how a user may request access to or correction of the personal data provided. Unless permitted or required by law, the PMSA will not disclose a user’s personal data to any third party without the user’s prior consent.

Data Access / Correction Request

The PMSA maintains a log book, as provided for in section 27 of the Personal Data (Privacy) Ordinance (Cap. 486). Request for access to or correction of personal data by the data subject shall be made to the Data Protection Officer appointed by the PMSA using the Data Access Request Form (OPS003) specified by the Privacy Commissioner for Personal Data. The completed form should be sent by post to: Units 806-8, 8/F, Dah Sing Financial Centre, 248 Queen’s Road East, Wan Chai, Hong Kong. Other than publications which are available free of charge, or at a price specified, the photocopying charge (in black and white) will be levied at HK$2 (for A4 size paper) or HK$4 (for A3 size paper) per page. We may charge a reasonable administration fee for processing a data access request. (Note: the above charges are subject to revision from time to time.)
