Property Management Services Authority Issues Disciplinary Sanction Order Against Property Management Company in respect of To Kwa Wan I-Feng Mansions Major Power Outage Incident

The Disciplinary Committee (DC) of the Property Management Services Authority (PMSA) has, pursuant to the Property Management Services Ordinance (Cap. 626) (PMSO), made a disciplinary sanction order against Kong Shum Smart Management Services Limited (Licence No.: C-155118) (Kong Shum) for committing a disciplinary offence under section 4(a) of the PMSO (i.e. misconduct or neglect in a professional respect) in respect of its handling of the major power outage incident at I-Feng Mansions in To Kwa Wan in July 2025. The order imposes a written reprimand on Kong Shum and a fine of HK$250,000 (the maximum fine under the PMSO is HK$300,000).

In handling the major power outage incident at I-Feng Mansions in July 2025, Kong Shum’s “Mechanism for Handling Emergencies” was deficient and fell short of public expectation for professional property management (PM) services. The shortcomings were serious and undermined public trust in the PM industry. During the incident, Kong Shum also failed to establish effective communication with supporting Government Departments, agencies and clients, thereby breaching the PMSA’s Code of Conduct on “Handling Emergencies” (Code No.: C12/2022), which constitute a serious disciplinary offence.

The Disciplinary Hearing Panel (the Panel) conducted a hearing on 27 November 2025. After carefully considering all relevant information of the case (including testimonies from various witnesses like officers from relevant Government Departments, district council member, person-in-charge of the elderly care centre in I-Feng Mansions, and employees of Kong Shum, etc., as well as Kong Shum’s representations) and applicable legal principles, the Panel unanimously determined that Kong Shum had committed misconduct or neglect in a professional respect, in contravention of section 4(a) of the PMSO, and thus imposed the above disciplinary sanction orders.

This is the first case involving a licensed PM company found to have committed professional misconduct or negligence since the full implementation of the PM Industry Licensing Regime in August 2023.

Kong Shum was legally represented at the hearing. Senior Counsel Martin HUI Siu-ting and Counsel Ferrida CHAN Hiu-in represented the PMSA as Presenter. The Panel also ordered Kong Shum to pay the PMSA’s costs as Presenter under the PMSO. Kong Shum has whereby paid the penalty and costs in full.

Dr. James WONG, Chairperson of the PMSA said, “As the statutory regulatory body of the PM industry, the PMSA is duty-bound to rigorously follow up and deal with any disciplinary offences committed by licensees under the PMSO. This case marks the first instance where a licensed PM company has been found committing professional misconduct or negligence. The PMSA hereby sends a clear message to the public and the industry that serious disciplinary offences will be dealt with rigorously to uphold professional standard and as a deterrent. The PMSA also solemnly reminds all licensees that they must continuously comply with relevant laws, regulations and the PMSA’s Codes of Conduct during the licence period and avoid committing any disciplinary offence.”

The above disciplinary sanction order will be gazetted next week in accordance with section 26(3)(b) of the PMSO.
