Formulate “Guidelines on Property Management Services Agreement” and Launch Licensed Property Management Companies
Property Management Database
In accordance with the requirement stipulated in the Property Management Services Ordinance (Cap. 626), the Property Management Services Authority (PMSA) will publish in the Gazette tomorrow the list of Property Management Company (PMC) and Property Management Practitioner (PMP) licence holders under the property management (PM) industry licensing regime as of 31 July 2025.
Under the PM licensing regime, the PMSA has already issued more than 820 PMC licences and over 20,000 PMP licences. Discounting those who have obtained both formal and provisional licences as well as those who hold more than one class of licence, there are currently more than 15,000 licensed PMPs actively working together to safeguard various types of properties in Hong Kong.
With the continued development of the PM services industry in Hong Kong and the full implementation of the PM licensing regime, PM services have become integral to the daily lives of the community. The PMSA is aware that various forms of “Property Management Services Agreement” exist in the market. However, members of property owners’ organizations responsible for such matters may not possess the necessary professional knowledge, and therefore may lack the resources and capability to properly handle the related tasks when entering into such agreement with PMCs. Providing reference material to assist in the proper formulation of such agreement could enhance the safeguard for the provision of PM services and benefit all parties involved. The PMSA aims to help property owners’ organizations and PMCs in clearly understanding their respective rights and responsibilities when entering into such agreement, protecting each other’s rights and interests, fostering more efficient collaboration, thereby enhancing the service quality and professional standard of PM services, promoting good PMSs, and minimizing unnecessary disputes and conflicts between the parties. For these reasons, the PMSA has formulated the “Guidelines on Property Management Services Agreement” (the Guidelines) to serve as a practical reference for property owners, owners’ organizations (including owners’ corporations), and PMCs when entering into PM services agreement for residential properties.
“Guidelines on Property Management Services Agreement”
The Guidelines describe issues of common concern in PM that often lead to disputes, presenting them as “Common Concern”. It outlines the PMSA’s reference guidance and recommendations in tabular form, along with relevant legal provisions/ codes, for the reference of property owners, owners’ organizations and the industry. The Guidelines cover various aspects involved in PM services agreement for typical residential properties, including the duration of services agreement, the rights of PMCs, and their obligations (including assisting owners in holding meeting, procuring supplies, goods or services, handling financial matters, carrying out maintenance and repair, and engaging contractors), as well as compliance with statutory requirement of Government authorities, service termination, handover arrangement, and dispute resolution mechanism, etc.
The Guidelines are for reference only and do not impose any mandatory requirement to incorporate all of its contents into any PM services agreement. If there are any uncertainties when drafting such agreements, independent legal or professional advice should be sought.
Licensed Property Management Companies Property Management Database
In addition, to facilitate public understanding of PM services provided by licensed PMCs across various districts in Hong Kong, the PMSA has launched the “Licensed Property Management Companies Property Management Database” (the Database). Through the Database, members of the public can access information on properties subject to deeds of mutual covenant managed by licensed PMCs across all 18 districts of Hong Kong.
The Database contains the information of properties managed by licensed PMCs, including the property name, address, the name of the licensed PMC providing the services, and its licence number. Users can search by property name or filter by district to conveniently locate the information they need.
Dr James Wong, Chairperson of the PMSA, said, “The PMSA is committed to promoting integrity within the PM industry and enhancing its professional service standard, with the aim of providing quality PM services to the community. Through issuing the Guidelines, the PMSA aims to assist property owners, owners’ organizations and PMCs in clearly understanding their respective rights and obligations when entering into PM services agreement. The launch of the Database further helps the public gain insight into the operation of licensed PMCs, thereby enhancing transparency in PM work.”
The Chairperson added, “Taking a dual approach from the perspectives of property owners and the general public, the PMSA has issued the Guidelines and launched the Database to not only enhance transparency in PM information, but also help further improve the professional service standard of the industry.
The above Guidelines and Database are available on the PMSA’s website (https://www.pmsa.org.hk/en/information-centre/publicdata). The Database currently contains information up to 31 July, and the PMSA will update the Database around every three months.
