Gazettal of Order of the First Disciplinary Hearing of the Property Management Services Authority
The Property Management Services Authority (PMSA) will, pursuant to Section 26(3)(b) of the Property Management Services Ordinance (Cap. 626) (PMSO), publish in the Gazette tomorrow the notice in respect of the first disciplinary order made by the Disciplinary Committee (DC) of the PMSA under Section 26(1) of the PMSO.
The very first disciplinary hearing of the PMSA since the implementation of the property management (PM) industry licensing regime as from August 2020 was held by the DC on 16 March. The hearing concerned two disciplinary offences committed by a licensed property management practitioner (PMP) (licensee), whereby the conditions imposed on the licensee’s provisional PMP (Tier 1) licence and PMP (Tier 1) licence were respectively contravened. The conditions in question require the licensee concerned to continue to meet the prescribed criteria for holding the relevant licences. However, the PMSA found out after issuing the licences that the licensee concerned did not meet the prescribed criteria for holding a provisional PMP (Tier 1) licence (i.e. failure to accumulate at least 10 years of PM work experience in Hong Kong within the 15 years prior to 1 August 2020). Furthermore, as the licensee concerned had not possessed a valid provisional PMP (Tier 1) licence within the three years prior to the application date in respect of the PMP (Tier 1) licence, the licensee concerned also did not meet the prescribed criteria for holding a PMP (Tier 1) licence. Having considered all relevant information and evidence, the DC ruled that both allegations of committing disciplinary offence were substantiated, and in accordance with Section 26(1) of the PMSO, ordered that the licensee’s provisional PMP (Tier 1) licence and PMP (Tier 1) licence be revoked.
Chairperson of the PMSA Dr James WONG said, “As the statutory regulatory body of the PM industry, the PMSA deals with all contraventions of disciplinary offences under the PMSO seriously. The PMSA has the responsibility to conduct disciplinary hearing in respect of the current case. Industry stakeholders should be alerted and those who would apply for licence must comply with the prescribed licensing criteria.”
The register of licensees on the PMSA website (https://pmsa.org.hk/en/licensing-regime/registers-of-licensees/ ) has also set out the disciplinary offences of the licensee concerned and information on the revoked licences.
