“Distribution and Display of Promotional Material” Code of Conduct

This Code of Conduct aims to provide practical guidance to licensed property management companies (PMCs) on handling distribution and display of promotional material. The Code of Conduct covers the following:

  1. Establishing a mechanism for handling distribution / display of promotional material;
  2. Formulation of procedures and guidelines on handling distribution / display of promotional material;
  3. Handling of applications for distribution / display of promotional material;
  4. Execution of distribution / display of promotional material;
  5. Removal of promotional material / restricting unauthorised distribution / display of promotional material; and
  6. Record keeping

Chairperson of the PMSA Dr James WONG said, “A licensed PMC may, in respect of property for which property management (PM) services are provided by it, from time to time handle request from owners, other persons, corporate bodies or organisations to distribute / display promotional material in the concerned property. The “Distribution and Display of Promotional Material” Code of Conduct helps PMCs to handle such requests in accordance with the principle of fairness, justice, sensible and compliance with the law.”

“Tree Management Work” Code of Conduct

This Code of Conduct provides practical guidance to licensees required to carry out tree management work in common parts of the property on how to advise and assist property owners in complying with applicable law, regulation and relevant provision in the land lease of the property related to tree management work. The Code of Conduct covers the following:

  1. Formulating tree management measures;
  2. Tree record and inspection;
  3. Monitoring service contractors and keeping record; and
  4. Issuing work notice and follow-up work.

Chairperson of the PMSA Dr James WONG said, “Planting trees on the common parts of a property not only provides a comfortable living environment for residents, it also helps increase the value of the property. However, failure in assessing the potential risk of planting trees and implement necessary mitigation measures in timely manner especially during typhoon season may very likely result in serious injury or damage to properties. The “Tree Management Work” Code of Conduct provides practical guidance for the PM industry to assist and remind owners in respect of proper management and maintenance of trees so as to enhance tree safety.”

The respective Best Practice Guides for the two Codes of Conduct “Distribution and Display of Promotional Material” and “Tree Management Work” have also been prepared to provide practical guidance for the PM industry to better comply with the Code. The PMSA has formulated the two Codes of Conduct and their respective Best Practice Guides in consultation with the PM industry, owners’ organisations, the Home Affairs Department and the Tree Management Office of the Development Bureau and has appropriately reflected the feedback received from the consultation in the Codes and Guides so that the content is more comprehensive, pragmatic and suitable for the use of the industry.

In response to the amendments made on 28 April 2023 in respect of the two ordinances concerning the provisions on penalties, the PMSA has updated the relevant provisions in the annexes of the relevant Codes and Guides.
