20 物業管理業監管局 2024-25 周年報告 提升專業標準,優化服務質素 為進一步提升業界專業服務水平,監管局 本年度針對業界實際需要,新制定《處理 消防安全工作》、《斜坡管理工作》及《處 理渠務工作》三份操守守則及相關良好作 業指南,為業界工作提供適切到位的實務 指引。 此外,針對棚架作業安全,監管局根據 勞工處 2024 年 10 月 19 日實施生效的《竹 棚架工作安全守則》修訂版,同步更新了 《處理棚架工作》操守守則及相關良好作 業指南,以協助提升業界職安水平。 同時,為配合於 2025 年 7 月 13 日實施的 《 2024 年建築物管理(修訂)條例》,監管 局已修訂了三份現行操守守則及相關良好 作業指南,包括《物業管理公司於《建築 物管理條例》下的責任》、《代客戶進行採 購服務及防止圍標》及《處理委任代表的 文書》,以配合新法例實施。有關操守守 則的修訂版已刊憲,並將與新法例同步生 效,確保業界有充足時間了解和適應新規 定,進一步提升物管專業水平,加強樓宇 物業管理。 在合規巡查方面,監管局自發牌制度過渡 期完結後至今已完成超過 1,000 個物業巡 查,涉及逾 660 間持牌物管公司。有關巡 查涵蓋港島、九龍及新界不同類型物業, 由不同規模的物管公司管理。針對近期發 現有物業泳池涉嫌聘用不合資格救生員當 值的情況,監管局自 2024 年 12 月起於巡 查擁有私人泳池設施的物業時,會關注管 理泳池的持牌物管公司是否按既定程序核 實當值救生員的專業資格,以及聘用足夠 合資格救生員在泳池當值並符合各項規 定。監管局於本年度已巡查逾 90 個有泳 池設施的物業,並確認相關物管公司均符 合法規要求。 Raising Professional Standard and Enhancing Service Quality To further enhance the industry’s professional service level, the PMSA this year promulgated three Codes of Conduct and the respective Best Practice Guides which are tailor-made for industry needs, including “ Handling Fire Safety Work ”, “ Slope Management Work ”, and “ Handling Drainage Work ”, providing practical and relevant guidance for industry operation. Regarding scaf folding work safety, the PMSA has also updated the Code of Conduct for “ Handl ing Scaffolding Works ” and the respective Best Practice Guide in line with the Labour Department’s revised “ Code of Practice for Bamboo Scaffolding Safety ”, which came into effect on October 19, 2024, so as to enhance occupational safety standard in the PM industry. I n preparat i on for the imp l ementat i on of the Bu i l d i ng Management (Amendment) Ordinance 2024 which would come into force on July 13, 2025, the PMSA has revised three existing Codes of Conduct and the respective Best Practice Guides, including “ Obl igat ions of Property Management Company under the Bui lding Management Ordinance, ” “ Carrying out Procurement for Cl ients and Prevent ion of Bid-rigging ” and “ Handling Instrument of Appointing a Proxy. ” The revised Codes have been gazetted and will take effect concurrently with the new legislation, ensuring the industry has suff icient time to understand and adapt to the new requirement, further enhancing professional standard and strengthening building management. In terms of compl iance inspection, since the end of the licensing regime’s transitional period, the PMSA has completed over 1,000 property inspections covering over 660 licensed PM companies. Such inspections cover various property types across Hong Kong Island, Kowloon and the New Territories, managed by PM companies of different scales. In response to recent f indings about propert ies engaging unqual i f ied lifeguards at swimming pool, the PMSA has, since December 2024, included checks during inspection of properties with private swimming pool facilities to ensure that licensed PM companies verify the qualification of on-duty lifeguards and employ suf f icient qual i f ied l i feguards in compl iance wi th regulations. This year, the PMSA inspected over 90 properties with swimming pool facilities and confirmed that the related PM companies complied with the regulatory requirement.
